The California case of a mother who claims her 7-year old daughter died due to a fatal reaction to Botox treatments for cerebral palsy is cited to be the first case alleging a dangerous reaction to the drug to reach trial.
Kristen Spears was born with severe cerebral palsy, started getting Botox injections at the age of 6, to calm spasms in her legs.
Botox, widely known as face lifting injection, can also relax contorted muscles and sometimes help young patients walk without surgery.
She died in November 2007 succumbing to a respiratory failure and pneumonia. Her mother, Dee, alleges in an Orange County court blaming an overdose of Botox to weaken muscles controlling her breathing.
Federal authorities last year mandated “black box” labels that bear a warning of potentially serious reactions to the drug. In addition, it unveiled the Irvine-based drug maker's own records of reported ill effects, revealing that the company knew of some serious problems linked to neurotoxins such as Botox as early as 2005.
However, the Irvine, Calif.-based drug maker Allergen Inc. preferred to remain quiet for the issue.
