The Constitution is clear.

Qualifications for the Office of President

Age and Citizenship requirements - US Constitution, Article II, Section 1

No person except a "natural born citizen", or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty-five years, and been fourteen years a resident within the United States.

Term limit amendment - US Constitution, Amendment XXII, Section 1 – ratified February 27, 1951

No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once.

Currently, Title 8 of the U.S. Code fills in those gaps. Section 1401 defines the following as people who are "citizens of the United States at birth:"
• Anyone born inside the United States *
• Any Indian or Eskimo born in the United States, provided being a citizen of the U.S. does not impair the person's status as a citizen of the tribe
• Any one born outside the United States, both of whose parents are citizens of the U.S., as long as one parent has lived in the U.S.
• Any one born outside the United States, if one parent is a citizen and lived in the U.S. for at least one year and the other parent is a U.S. national
• Any one born in a U.S. possession, if one parent is a citizen and lived in the U.S. for at least one year
• Any one found in the U.S. under the age of five, whose parentage cannot be determined, as long as proof of non-citizenship is not provided by age 21
• Any one born outside the United States, if one parent is an alien and as long as the other parent is a citizen of the U.S. who lived in the U.S. for at least five years (with military and diplomatic service included in this time)
• A final, historical condition: a person born before 5/24/1934 of an alien father and a U.S. citizen mother who has lived in the U.S.

* There is an exception in the law - the person must be "subject to the jurisdiction" of the United States. This would exempt the child of a diplomat, for example, from this provision.

Anyone falling into these categories is considered natural-born, and is eligible to run for President or Vice President. These provisions allow the children of military families to be considered natural-born, for example.

As long as Obama hides his papers the case will escalade and more lawsuits will rise, i am hopefull Berg's lawsuit will bring the light on this, if Obama was born in Kenya then the constitution says he must leave

Sounds like Hawaii officials want to be nice with Obama, it's their hero, so although they seem to find zero records about birth (rather than registration) they can make a fuzzy statement (we have 'verified') and liberal media and Obama fans will take it and extrapolate the statemet into 'they have proven that he was born in Hawaii'.

Original Birth Certificates in Hawaii are considered private and always under seal and not released to anyone but the person. Many states follow this policy for other government documents. Many states will not release original documents (or copies) to just anyone. For example, if you are a parent with a child in a college or university, you may not have access to your child's grades sometimes even if you have your child's permission.

It is a short form copy of his birth certificate (the only kind Hawaii will release). Short form copies in Hawaii do not list all the information of the long form copies like hospital's name. The State of Hawaii has verified that it is an authentic copy. Those who have a short form copy of Hawaii birth certificates have noted it is the same form as Obama's.

Obama has NOT released an unaltered copy of his birth certificate. He has NOT released any hospital or doctor records that show where he was born and who the doctor was. (He has also NOT released other significant documents, like his college records or his thesis.) He has NOT released the records of his adoption or his Indonesian passport. He has NOT released even an altered copy of the long form of his birth certificate that would give the kind of information that would completely satisfy and silence the “birthers” (at least most of them). His pattern of hiding and obscuring and even lying about his past (like stating in writing in a formal document that he never went by or used a different name) is over the top and is one of the reasons why I do not trust anything he says and would put nothing past him.

For myself and many like me, until he answers these questions (which he could easily do if he just released the documents), we will not recognize him as the president, we will not recognize any legislation he signs as law, we will not view any orders he gives the military as binding, we will not view any judges he appoints or the decisions they make as anything other than bogus.

The Donofrio case, which was considered in conference by the Supreme Court on Friday, begins with the assumption that Obama *was* born in Hawaii. Donofrio does not deny nor seek proof of Obama's Hawaii birth.

Instead, Donofrio alleges that Obama is not a "natural born citizen." Obama's father was, at the time of Obama Jr.'s birth, a Kenyan national with British citizenship -- a British subject. Donofrio's interpretation of the law is that Obama Jr. is constitutionally prohibited from the presidency because of this dual citizenship at birth.

Obama's website confirms the dual citizenship:

If there is validity to question the authenticity of whether BO is able to take office, the Court MUST consider it. This isn't some issue they've already made a prior decision on or a lower court has already provided an answer.

If they don't, then our constitution is truly eroding. I only want an American to be President over the USA, not some Kenyan. Even though it's not his fault he was born in Kenya, the same can be said for billions of other people. There's a reason behind the standard, and if he's not a natural born citizen of the USA, then... I guess Bush continues until we elect an American.

Natural born citizen is described in a deceased document called the constitution.If the president elect is not a citizen,our govt will sweep it under the rug rather than contend with the chaos of keeping the first black man out of the White House!!!

If you really were born in America, simply prove it and end the question.

This is all so absurd. Even if Obama was born in Kenya, he would still be a U.S. citizen because one parent was a U.S. citizen. The U.S. Dept. of State website,

IT SIMPLY DOES NOT MATTER WHERE HE WAS BORN. HIS MOTHER WAS A U.S. citizen. OBAMA IS A U.S. CITIZEN!!!! He was born in Hawaii, but even if he was somehow born in Kenya or the moon, he is a citizen. The problem is the stupid people out there who don't bother checking the law.

On his own webstite Obama states that he was a British Citizen at birth. This disqualifies him according to the Constitution. Obama knew this years ago but rather than clear it up, he chose to cover and confuse it hoping the media would go along.

I don't care much whether Obama is a U.S. citizen. It's not like he's going to respect the Constitution, even if he is a citizen. What bothers me is that the man is a Communist, and I simply cannot allow my children to live in a country whose wealth and liberty is destroyed by this evil ideology.

The majority of this country voted for Obama. He most certainly cannot remember what geographical location he was at the time of his birth. His mother was a US citizen. If this election is somehow decided by the supreme court there will be absolute chaos. What kind of a message does this send to the rest of the world? Unless the judges sitting on that court are totally ignorant, they will refuse to consider this matter. Why was this not brought before the court at the time he was running? and what else will the sore losers come up with?

Don't base your argument on a lack of a HOSPITAL name. Some people are born at home.

If this Obama birth certificate thing proves he is ineligible for the presidency- what happens then-Biden or Mccain or another vote?
