Submitting a request to Judge Denny Chin of the US Federal Court for the Southern District of New York, the Author’s Guild attorney, Michael Boni, has urged for a delay in the submission of a revised settlement regarding Google Books - till Friday, November 13.
Judge Chin, who had earlier given the November 9 deadline for the submission of the settlement between the Author’s Guild and Google, has approved the request.
In his request for extension of the deadline, Boni wrote: “I write to advise the court that the Guild expect to file their motion seeking preliminary approval of the amended settlement by no later than Friday, November 13, 2009.
Boni added that the concerned parties are “working diligently on completing and filing the amended settlement agreement,” and had been “in discussions with the Department of Justice both prior to and since the October 7 status conference.”
The long-drawn-out legal scuffle between Google and the Author’s Guild began in 2005, when the Guild filed a lawsuit against Google, accussing Google of copyright violation by intending to digitize out-of-print books.
Though a settlement between Google and the Author’s Guild came through in October 2008 - Google agreed to pay $125 million to the rights holders and limit the digitization of certain out-of-print books, the US Department of Justice requested the court to reject the agreement in September this year.
